These Recipient Terms ("Terms") govern your use of KIND ("KIND", "the Platform", "we", "us") as a recipient — anyone who creates a KIND page to receive appreciation, tips, donations or other payments ("Appreciation"). By creating a KIND page, you agree to these Terms.
1. What KIND is
KIND is a facilitation service. It gives you a public page, link, QR code and related tools through which other people ("Payers") can send you Appreciation. KIND is not a bank, a charity, a payment institution, an employer or a party to the relationship between you and any Payer.
2. Eligibility and your account
- You must be at least 18 years old and legally able to enter a binding contract.
- You must provide accurate information on your page and keep it up to date.
- You are responsible for everything that happens under your account and for keeping your sign-in credentials confidential.
- One person may operate multiple pages only where each page represents a genuine, distinct activity or identity.
3. Payments and payouts
- Payments are processed by Stripe, Inc. and its affiliates ("Stripe"). To receive payouts you must complete Stripe's Connect onboarding, agree to the Stripe Connected Account Agreement, and be in a country where Stripe Connect is available.
- KIND never takes possession of your funds. Appreciation is paid by the Payer through Stripe and settled to your connected account on Stripe's schedule.
- You are responsible for any information, identity verification, bank account or tax documentation Stripe requires for your country.
- If Stripe does not support your country of residence, you may still create a KIND page, but you cannot receive payouts through KIND.
- KIND may deduct a platform service fee from Appreciation, as stated on the pricing page at the time of the payment. Stripe's own processing fees also apply.
- Payouts may be delayed, reversed or refused where required by Stripe, by law, or to investigate fraud, chargebacks or abuse.
4. Your page and content
- You retain ownership of the text and images you publish, and grant KIND a worldwide, non-exclusive licence to host and display them for operating and promoting the Platform.
- You must not publish content that is unlawful, defamatory, deceptive, infringing, or that impersonates another person.
- You must not use your page to sell goods or services that are illegal, or to fundraise for purposes you do not genuinely pursue.
- KIND may suspend or remove pages that breach these Terms or that create legal or reputational risk.
5. Taxes
Appreciation you receive may be taxable income in your jurisdiction. You are solely responsible for determining and fulfilling your tax obligations. KIND does not provide tax advice and does not report or remit taxes on your behalf, except where the law requires it.
6. Refunds, disputes and chargebacks
If a Payer disputes a payment, Stripe's dispute process applies and the disputed amount (plus any dispute fee) may be deducted from your balance. You agree to cooperate reasonably in resolving disputes. KIND may, but is not obliged to, mediate between you and a Payer.
7. Liability
The Platform is provided "as is". To the maximum extent permitted by law, KIND is not liable for indirect or consequential losses, for lost Appreciation, or for acts or omissions of Stripe or Payers. Nothing in these Terms limits liability that cannot be limited by law.
8. Termination
You may close your page at any time from Settings. KIND may suspend or terminate access for breach of these Terms, with notice where practicable. Amounts already settled to your connected Stripe account are unaffected by termination.
9. Changes and governing law
We may update these Terms and will post the revised version with a new "last updated" date; material changes will be notified in the app. These Terms are governed by the laws of the jurisdiction in which the KIND operating entity is established, without regard to conflict-of-laws rules. Legal notices can be sent to info@kind.us.org.
