These Payer Terms apply when you send appreciation, a tip, a donation or any other payment ("Appreciation") to someone through KIND ("the Platform"). You do not need a KIND account to send Appreciation; by completing a payment you accept these Terms.
1. The nature of your payment
- Appreciation is a voluntary payment from you to the recipient. KIND facilitates the payment but is not the recipient and does not endorse any recipient.
- Unless the recipient is a registered charity that tells you otherwise, Appreciation is not a charitable donation and is generally not tax-deductible.
- Appreciation is not a purchase: it does not entitle you to goods, services or any future performance from the recipient, unless you agree that separately with them.
2. How payments are processed
- Payments are processed by Stripe, Inc. and its affiliates. Your card or payment-method details are collected and stored by Stripe, not by KIND.
- You authorise us to charge the amount you select, in the currency shown at checkout, plus any explicitly displayed fees.
- Available payment methods and the currency presented may vary depending on your location and what Stripe supports there.
- The final amount shown at checkout includes any applicable tax, calculated by Stripe based on your billing location.
- A payment is complete when Stripe confirms it. You will see a confirmation on screen; the recipient sees the Appreciation in their KIND dashboard.
3. Fees
Any optional supporter fee or platform contribution is shown clearly before you confirm, and is always your choice. The amount the recipient receives may be reduced by payment-processing and platform fees as described on the pricing page.
4. Refunds
- Appreciation is generally final and non-refundable once confirmed, because it is transferred toward the recipient's account promptly.
- If you believe a payment was unauthorised or made in error, contact us promptly at info@kind.us.org and we will review it with Stripe.
- You may also dispute a charge with your card issuer. Unfounded chargebacks may result in the amounts being recovered.
- Nothing in these Terms limits any mandatory consumer rights you have under applicable law.
5. Your responsibilities
- Only send Appreciation with a payment method you are authorised to use.
- Do not use the Platform for money laundering, to test stolen cards, or to route funds between accounts you control.
- Messages you attach to Appreciation must be lawful and respectful; recipients can hide or report them.
6. Liability
KIND is responsible for operating the payment flow with reasonable care. KIND is not responsible for the recipient's conduct, for how Appreciation is used, or for statements on recipient pages, which are the recipient's own content.
7. Changes and governing law
We may update these Terms; the version published at the time of your payment applies to it. These Terms are governed by the laws of the jurisdiction in which the KIND operating entity is established. You can reach us at info@kind.us.org.
